These Terms and Conditions (“Agreement”) govern your use of the Fawkes website and participation in the Fawkes customer acquisition program. By accessing this website, submitting an application, or partnering with Fawkes, you agree to be bound by these Terms.
If you do not agree, do not use this website or services.
1. Services Provided
Fawkes provides marketing, outreach, and customer acquisition services for independent residential cleaning companies.
Fawkes’ role is strictly limited to:
Marketing and promotional activities
Directing interested homeowners to book cleaning services
Delivering customer information to partnered cleaning companies
Fawkes does not perform cleaning services, manage cleaning operations, set pricing, collect payment from homeowners, or supervise service delivery.
2. Independent Contractor Relationship
All cleaning companies partnering with Fawkes operate as independent contractors.
Nothing in this Agreement creates:
An employer–employee relationship
A joint venture
A franchise
A partnership
Cleaning companies are solely responsible for:
Licensing and insurance
Pricing and service fulfillment
Customer communication and satisfaction
Compliance with all local, state, and federal laws
3. Customer Ownership & Responsibility
Once a customer is delivered:
The customer relationship belongs to the cleaning company
All scheduling, pricing, disputes, cancellations, refunds, and service outcomes are handled directly between the cleaner and the customer
Fawkes has no ongoing responsibility once the customer is delivered
4. Billing & Fees
Cleaning partners agree to pay a monthly recurring fee per active customer delivered by Fawkes.
Billing begins immediately upon customer booking
Fees are billed automatically on a recurring basis
Fees continue for as long as the customer remains active with the cleaning company
Proof of Cancellation
If a customer cancels services, the cleaning company must provide verifiable proof of cancellation upon request. Without verification, billing will continue.
5. No Guarantees
Fawkes makes no guarantees regarding:
Number of customers delivered
Frequency of bookings
Revenue, profits, or job size
Customer longevity or retention
Results vary based on market conditions, pricing, service quality, availability, and follow-up.
6. No Refunds / No Chargebacks
All fees paid to Fawkes are non-refundable.
By participating, you expressly agree that:
Fees are earned upon customer delivery
Dissatisfaction with customer behavior, cancellations, or service outcomes does not qualify for refunds
You will not initiate chargebacks, payment disputes, or reversals
Unauthorized chargebacks may result in immediate termination of service and collection actions.
7. Limitation of Liability
To the fullest extent permitted by law, Fawkes shall not be liable for:
Customer disputes
Lost revenue or profits
Scheduling conflicts
Property damage
Service quality issues
Customer cancellations or non-payment
Total liability, if any, shall not exceed the amount paid to Fawkes in the 30 days preceding the claim.
8. Indemnification
You agree to indemnify and hold harmless Fawkes from any claims, damages, losses, or legal actions arising from:
Your cleaning services
Customer interactions
Misrepresentation of your business
Failure to comply with laws or regulations
9. Termination
Fawkes reserves the right to suspend or terminate partnerships at any time for:
Misrepresentation
Abuse of customers
Payment failures
Violation of these Terms
Termination does not relieve outstanding payment obligations.
10. Modifications
Fawkes may update these Terms at any time. Continued use of the website or services constitutes acceptance of updated Terms.
11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict-of-law principles.
